1.         HERE’S HOW TO ENTER:  There are two ways to enter the DRINK TWIST & WIN (“Sweepstakes”), beginning 12:00:01 AM PST August 1, 2011 and ending 12:00:00 PM PST September 11, 2010:

(a).  To enter online, entrants may visit http://www.drinktwist.com and complete an online entry form, including all requested information, including complete name, address (no P.O. Boxes), city, state, zip code, daytime phone number, email address and date of birth.  Online entries must be received by 12:00:00 PM PST on September 11, 2011 andmust be complete in order to be eligible.  Online entries generated by script, macro or other automated means are void.  Normal Internet access and usage charges imposed by entrants’ online service will apply and shall be the sole responsibility of the entrant.  Neither TalkingRain Beverage Company (the “Sponsor”), William Sonoma,their respective parent companies, subsidiaries, affiliates and the directors, officers, employees or agencies, nor any of their respective partners or prize suppliers (collectively, the “Sponsor Affiliates”) assume any responsibility for incorrect or inaccurate capture of entry information, including, but not limited to, technical malfunctions, human or technical error, printing errors, lost/delayed/garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof.

 (b).  On a plain 3 x 5” piece of paper, entrants may hand print their complete name, address (no P.O. Boxes), city, state, zip code, daytime phone number, email address (optional) and date of birth.  Entrants must mail their entries in a stamped #10 envelope to:  DRINK TWIST & WINSweepstakes, P.O. Box 549, Preston, WA 98050.  Mail-in entries are limited to 1 entry per stamped envelope.  One entry per person.  Each mail-in entry must be received by September 19, 2011, 12:00:00 PM PST.  Neither the Sponsor or Sponsor Affiliates are responsible for lost, late, damaged, delayed, destroyed, misdirected, incomplete, illegible, mutilated or postage due mail.  Photocopies, mechanically reproduced, forged or altered mailed entries and facsimiles are void.  Incomplete entries are not eligible.  Mail-in envelopes larger than a #10 envelope will be automatically disqualified. 

 

2.         ELIGIBILITY:  The Sweepstakes is only open to legal residents of the United States and the District of Columbia, who are 21 years of age or older as of August 1, 2011.  Employees of the Sponsor and Sponsor Affiliates and any of the members of their immediate family (defined as spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren) or same household of each are not eligible to participate.  This Sweepstakes is void outside of the United States and the District of Columbiaand where prohibited or restricted by law, and is subject to all applicable federal, state and local laws.  One (1) entry per person.  Void where prohibited. 

 

3.         GRAND PRIZE AND APPROXIMATE RETAIL VALUE (“ARV”):  One(1) Grand Prize winner  will receive one (1) William Sonoma giftcard valued at $1,000.00.  One (1) Second Place winner will receive one William Sonoma gift card valued at $500.00.  Third Place winner will receive one (1) William Sonoma gift card valued at $250.00.   Sponsor reserves the right to substitute prize (or portion of the prize) with one of equal or greater value if the prize cannot be awarded as described for any reason.  All William Sonomarestrictions apply.  Once prize is issued all restrictions of William Sonoma gift card are applied.  Cannot be redeemed for cash, lost or stolen cards are not replaceable.    

 

4.         RANDOM DRAWING:  The winner will be selected in a random drawing no later than September 30, 2011from among all eligible entries received.  The drawing will be conducted by TalkingRain Beverage Co. whose decisions are final and binding on all matters related to this Sweepstakes.  Odds of winning are dependent upon the number of eligible entries received for the drawing.

 

5.         WINNER NOTIFICATION/VERIFICATION:  The potential winnerswill be notified by phone, email and or mail and will be required to complete, sign and return, a notarized Affidavit of Eligibility/Release of Liability and, where legal, Publicity Release.  The potential winner is required to return the document within 14 days from the postmark date on the prize notification letter or prize may be forfeited and an alternate winner selected.  If the prize notification is returned as undeliverable, prize will be forfeited, and an alternate winner will be selected.  Winner is responsible for any and all federal, state and local taxes. 

 

6.         GENERAL RULES:  The Sponsor reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or violates the Official Rules.  In the event this Sweepstakes is compromised or becomes technically corrupted in any way, electronically or otherwise, the Sponsors reserve the right to cancel, terminate or suspend the online portion of the Sweepstakes and in such event to select winner by random drawing from among all valid online entries received up to such time of cancellation, termination or suspension and all eligible mailed entries received.  Entrants agree to be bound by these Official Rules and the decisions of the judges.  All aspects of the prize are nontransferable and no substitutions are allowed except at the Sponsor’s sole discretion.  No cash equivalent or exchange of prize is permitted (except at the Sponsor’s sole discretion).  All other expenses and costs, not expressly listed above, including, but not limited to, taxes, tips, etc. are the winner’s sole responsibility.  The winner agrees to indemnify and hold harmless and waive any and all claims of liability of any kind whatsoever against the Sponsor and/or the Sponsor Affiliates, including any accident, loss, injury or death occurring or in any way related to the prize or use/misuse thereof or while traveling to and/or from a location to obtain or use the prize.  Neither the Sponsor nor the Sponsor Affiliates make any warranty, representation or guarantee, express or implied, in fact or in law, relative to the use of the prize including, without limitation, quality, merchantability and fitness for a particular purpose.  The winner, in accepting his/her prize, consent to the use of his/her name, address (city, state), photograph and likeness for purposes of advertising, trade and promoting in any and all media on behalf of the Sponsor, without further compensation, except where prohibited by law. 

 

7.         GOVERNING LAW & VENUE:  The Washington State Courts (State & Federal) shall have sole jurisdiction of any controversies regarding the promotion and the laws of the state of Washington shall govern the same.  Each entrant waives any and all objections to jurisdiction and hereby irrevocably submits to the venue of those courts within King County, Washington.

 

8.         WINNER’S NAME/RULES:  To receive the Winner’s Name or Rules, mail a self-addressed, stamped envelope, by September 30, 2011, to:  DRINK TWIST & WINSweepstakes,Winner’s Name Request/Rules, PO Box 549, Preston, WA 98050.
